Acceptable Use Policy
What you may and may not do with Azmarq's platform and communications services.
Draft for legal review. Template for Azmarq Technovation Pvt. Ltd. Incorporated by reference into the Terms of Service.
1. Purpose
Why this Policy exists.
This Acceptable Use Policy ("AUP") sets the rules for using the services of Azmarq Technovation Pvt. Ltd. ("Azmarq"). It protects recipients, operators, channel partners, and the integrity of the messaging ecosystem. It applies to every customer, user, and reseller, and forms part of our Terms of Service. Breaching it may lead to filtering, suspension, or termination, and to reporting to operators, channel providers, or authorities.
2. Consent and recipient rights
The consent baseline for all traffic.
You may only send communications to recipients who have given valid, demonstrable consent to receive them for the relevant purpose, or where another lawful basis clearly applies. You must honour opt-out and unsubscribe requests promptly, maintain suppression lists, and be able to provide evidence of consent on request. You must not message recipients on do-not-disturb registries in breach of applicable rules.
3. Prohibited content and conduct
What may never be sent or done.
You must not use the Services to send, facilitate, or store content that:
- is unlawful, fraudulent, deceptive, or misleading, including phishing, smishing, spoofing, and impersonation;
- promotes or facilitates scams, financial fraud, pyramid or Ponzi schemes, or unauthorised financial or investment solicitation;
- is spam or unsolicited bulk messaging, or uses purchased, scraped, or harvested contact lists;
- infringes intellectual property or privacy rights, or discloses others' personal data without a lawful basis;
- is defamatory, harassing, threatening, hateful, or incites violence or discrimination;
- is obscene, sexually exploitative, or harmful to minors;
- contains malware, or links to malicious or deceptive destinations;
- promotes illegal goods or services, or content restricted by law or by the applicable channel or operator;
- violates the policies of any channel (including Meta's WhatsApp Business policies), operator, or regulator.
You must not attempt to gain unauthorised access to, disrupt, overload, probe, or reverse-engineer the platform, circumvent usage limits or security controls, or use the Services to distribute another party's traffic in a way that evades registration, attribution, or filtering.
4. Sender identity and message integrity
Accurate, non-deceptive originators.
You must use accurate sender identities and approved sender IDs, headers, and templates, and must not disguise, forge, or obscure the origin of messages. Category rules (transactional, service, marketing/promotional) must be respected, and content must match the declared category and registered template.
5. Channel- and country-specific rules
Additional obligations by channel and market.
You must comply with all channel- and country-specific requirements, including India's TRAI regulations and DLT registration of entities, headers, and templates; WhatsApp/RCS/SMS/voice/email provider policies; sender-ID registration regimes; and permitted calling/messaging windows for promotional traffic. Detailed messaging rules are set out in our Anti-Spam & Messaging Compliance Policy.
6. Security and resource use
Protecting the platform and others on it.
You must protect your credentials and API keys, use the Services within agreed throughput and fair-use limits (including SMPP binds, API rate limits, and inbox concurrency), and not engage in activity that degrades service for others. Report suspected vulnerabilities or compromise to us promptly. Use of AI Agent Studio and automated agents is also subject to our AI & Automated Processing Policy.
7. Monitoring and enforcement
How we uphold this Policy.
We do not routinely monitor message content, but we may inspect traffic and metadata to protect the platform, investigate suspected abuse, and comply with law and operator obligations. Where we identify a breach, we may throttle, filter, suspend, or terminate the account, withhold delivery, and report to operators, channel partners, or authorities. We may act immediately without notice where necessary to prevent harm.
8. Reporting abuse
How to raise concerns.
Suspected abuse, spam, or fraud involving traffic on our platform can be reported per our Trust & Safety — Report Abuse page.
9. Changes
Updates to this Policy.
We may update this AUP; the current version is shown by the "Last updated" date. Continued use constitutes acceptance.
