Law Enforcement Guidelines
How authorities can make lawful requests for data, and how Azmarq responds.
Draft for legal review. Template for Azmarq Technovation Pvt. Ltd. Confirm the intake channel, verification requirements, and escalation process with counsel.
1. Purpose
Who this page is for.
These Guidelines explain how Azmarq Technovation Pvt. Ltd. ("Azmarq") handles requests from law enforcement and government authorities for customer or user data. We are committed to protecting our customers' and their users' data while complying with valid legal process.
2. Legal basis for requests
What we require.
We disclose data only where we are legally compelled by valid process appropriate to the jurisdiction and the type of data sought, or where an exception under applicable law applies. Requests must be lawful, specific, and issued by an authorised body. We may decline or seek to narrow requests that are overbroad, vague, or legally deficient.
3. How to submit a request
The intake process.
Authorised requests should be submitted on official letterhead by an authorised officer to lawenforcement@azmarq.com, and must identify the requesting authority and officer, the legal authority relied on, the specific data sought, the relevant account or identifier, and the legal process attached. We verify the authenticity of requests before responding.
4. Data Azmarq may hold
What can and cannot be provided.
Azmarq is primarily a Data Processor for message content routed by its customers, and holds limited data as a controller (such as account and billing information). Where a request concerns content or end-user data that belongs to a customer, we will, unless legally prohibited, direct the authority to the customer as the appropriate data controller, or notify the customer so they may respond, consistent with law.
5. User notice
When we tell the affected party.
Where permitted by law and not prohibited by the legal process (for example, by a valid non-disclosure order), we will make reasonable efforts to notify the affected customer of a request before disclosure, so they may seek to protect their interests.
6. Emergency requests
Urgent situations involving risk to life.
In genuine emergencies involving an imminent risk of death or serious physical harm, authorised authorities may submit an emergency request to emergency@azmarq.com with sufficient detail to assess the risk. We evaluate such requests carefully and may disclose the limited data necessary to address the emergency where permitted by law.
7. Costs and record-keeping
Administrative matters.
We may recover reasonable costs of responding where permitted, and we maintain records of requests consistent with our legal obligations.
